    Obiettivi formativi

    Il corso ha per oggetto l’analisi giuridica – in chiave comparatistica – dei sistemi giuridici arabo-islamici caratterizzati da una profonda dialettica storica tra diritto religioso e diritto statale, tra tradizione e modernizzazione.
    Il metodo comparativo, attraverso l'analisi diacronica e sincronica dei diversi istituti, consentirà di comprendere meglio il ruolo della tradizione giuridica musulmana così come essa si è progressivamente sviluppata e diversificata nel corso della storia, tenendo in considerazione sia le problematiche collegate all’islàm come sistema giuridico-religioso, sia la recezione di modelli giuridici occidentali nella legislazione degli stati contemporanei.
    Obiettivo principale del corso è la comprensione dei molteplici livelli operazionali e teoretici che sussistono all’interno degli ordinamenti in questione e nei rapporti trans-nazionali.
    Sarà privilegiata, a questo fine, la prospettiva ermeneutica del rapporto sharì‘a / qànùn nella dottrina e nella giurisprudenza contemporanee.
    Lo studente, a termine del corso, avrà la capacità di
    1) comprendere la nozione di shari'a come diritto religioso e la sua influenza sui processi giuridici storici e contemporanei nei paesi islamici
    2) ricostruire storicamente lo sviluppo del diritto musulmano classico
    3) individuare correttamente i singoli istituti giuridici islamici
    4) ricostruire la formazione dei sistemi giuridici contemporanei degli stati musulmani
    5) operare con le fonti giuridiche del diritto vigente nei singoli stati
    6) risolvere casi concreti di applicazione del diritto dei paesi islamici
    7) analizzare le questioni giuridiche del mondo islamico anche in chiave geopolitica

    Prerequisiti

    Si suggerisce lo studio preliminare del seguente volume:
    Ajani G. - Francavilla D. - Pasa B., Diritto Comparato. Lezioni e Materiali, Torino, Giappichelli, 2018
    o altro testo di comparazione giuridica che introduca la metodologia e la classificazione dei sistemi giuridici.

    Metodologie didattiche

    Lezioni frontali (60% ca. delle ore previste), esercitazioni (20% ca.), attività seminariali, analisi di casi giurisprudenziali, lavori di gruppo (circa 20% ca.).
    Come ausilio alle lezioni frontali possono essere utilizzati: slide, supporti informatici, audio e video.
    È necessaria la consultazione delle fonti normative (aggiornate) richiamate a lezione e nei testi utilizzati.
    ATTIVTA’ DI TUTORATO E RECUPERO: Nel corso del semestre, su richiesta degli studenti, potranno essere organizzati incontri didattici per il tutorato o il recupero di argomenti trattati nel corso delle lezioni.

    Metodi di valutazione

    Ciascuno studente può optare per l’esame scritto ovvero l’esame orale prenotandosi ai corrispondenti appelli. In entrambi i casi vengono proposti quesiti attinenti a profili generali e specifici concernenti i “Contenuti” sopra elencati.
    PROVA SCRITTA: da quattro a sei domande a risposta aperta di diversa difficoltà, delle quali almeno due sulla parte generale, da completare in 2 ore. In caso di esito positivo, lo studente potrà comunque chiedere al docente un’integrazione orale della prova.
    PROVA ORALE: minimo quattro domande di diversa difficoltà, delle quali almeno due sulla parte generale. Il numero delle domande dipende dalla capacità dello studente di rispondere in modo corretto ed esaustivo.
    L’esame non sarà superato se lo studente non raggiunge nessuno dei risultati descritti al punto “Obiettivi formativi”.
    Il PUNTEGGIO è un voto espresso in trentesimi ponderato sulla preparazione dello studente in base a conoscenza, comprensione della disciplina, capacità di analisi e di interpretazione dei dati giuridici, capacità di restituire le competenze acquisite in forma chiara, lineare e ragionata, di livello:
    - sufficiente: voto tra 18 e 21;
    - discreto: voto tra 22 e 24
    - buono: voto tra 25 e 26
    - molto buono: voto tra 27 e 29
    - eccellente: voto tra 30 e 30 e lode
    PER GLI STUDENTI FREQUENTANTI:
    il docente tiene conto, in misura non superiore al 30% della valutazione complessiva, delle valutazioni espresse in riferimento alle esercitazioni svolte in aula.
    Il docente potrà attribuire alle esercitazioni svolte in aula nel corso del periodo di lezione un valore pari fino al 30% della valutazione complessiva ai fini del voto d’esame.
    PER GLI STUDENTI NON FREQUENTANTI: il voto finale è determinato sulla base della corrispondenza tra esiti della prova orale e descrittori degli “Obiettivi formativi”.

    Agli studenti frequentanti (presenza pari o superiore al 70% delle lezioni) sarà comunicato il programma per lo svolgimento dell’esame.
    Letture integrative ovvero eventuali programmi alternativi possono essere concordati direttamente con il docente sulla base degli interessi e delle esigenze formative individuali emerse durante le lezioni.
    La frequenza del corso non è obbligatoria.
    STUDENTI LAVORATORI INSERITI NEI PROGETTI IN CONVENZIONE: Il docente organizza specifici incontri di tutorato per gli studenti lavoratori secondo un calendario concordato con gli Enti convenzionati. Il programma di studio, per il raggiungimento degli obiettivi formativi, è equivalente a quello degli studenti frequentanti (vd. Testi di riferimento) integrato da dispense e altri materiali forniti dal docente a conclusione dell’attività di tutorato. La consistenza di tali programmi non comporta, in ogni caso, un impegno di formazione inferiore a quello richiesto alla generalità degli studenti.

    Il corso affronta i seguenti argomenti in una prospettiva comparatistica:
    I. La sharì‘a e il sistema delle fonti (usùl al-fiqh) L’islam, la Comunita dei credenti (umma) e i fondamenti etico-religiosi del diritto La nozione di shari‘a Il fiqh e la classificazione degli atti giuridici Le fonti (usul al-fiqh): il Corano - la Sunna - il consenso della Comunita (igma‘) - il procedimento analogico (qiyas) – la consuetudine (‘urf) - altre fonti sussidiarie - prassi e giurisprudenza forense (‘amal). L'attivita ermeneutica della dottrina (igtihad e taqlid)
    II. Gli istituti (furû‘ al-fiqh) e la codificazione (qànùn) Le ‘ibadat (gli atti di culto e le altre regole rituali) e le mu‘amalat (gli atti negoziali) Le persone – il diritto di famiglia – i diritti reali e il possesso. - le obbligazioni e i contratti - il diritto penale - il giudice e il processo

    Course objectives

    The course has as its object the legal analysis –from a comparative law perspective– of Arab-Islamic legal systems marked by strong historical dialectics between religious law and state law and between tradition and modernization.
    Through a diachronic and synchronic analysis of legal institutes, the comparative methodology allows us to better understand the role of Muslim legal tradition and how it has progressively developed and diversified throughout history, taking out account both issues related to islàm as a religious-legal system and receipt of western legal models into the legislation of contemporary States.
    The main objective of the course is the understanding of the multiple operational and theoretical levels existing within the legal systems under consideration and in transnational relations.
    The focus will be on the hermeneutical perspective of the relationship sharì‘a / qànùn in contemporary legal doctrine and jurisprudence.
    After completing the course, student will be able to:
    1) understand the concept of shari'a as a religious law and its influence on historical and contemporary legal processes in Muslim countries
    2) reconstruct the historical evolution of classical Muslim law
    3) properly identify each Islamic legal institute
    4) reconstruct the formation of contemporary legal systems in Muslim States
    5) work with the legal sources of the law in force in individual States
    6) resolve concrete cases of application of law in Islamic countries
    7) analyse the legal issues of Islamic world also from a geopolitical perspective

    Prerequisites

    It is suggested the preliminary study of the following text:
    Ajani G. - Francavilla D. - Pasa B., Diritto Comparato. Lezioni e Materiali, Torino, Giappichelli, 2018
    or another comparative law text which introduces the methodology and classification of legal systems.

    Teaching methods

    Lectures (60% ca. of the total available hours), exercises(20% ca.), seminaries, analysis of the case-law, work groups (about 20% ca.).
    Slides, audio and video information media may be used as an aid to lectures.
    Consultation of updated normative sources and other texts cited during the lectures is needed.
    TUTORIAL AND RECOVERY ACTIVITIES: During the semester, when personally required by the student(s), tutorial meetings could be scheduled for the recovery of topics dealt during the lectures.

    Evaluation methods

    Each students can opt for the written or the oral examination, booking the roll call. In both cases, the examination takes place on the general and special subject of the aforementioned “Contents”.
    WRITTEN EXAMINATION: from 4 to six open-ended questions of different difficulty, two of which at least verting on the general part, to be answered in two hours. In case of positive outcome, the student could, anyway, ask for a supplementary oral examination.
    ORAL EXAMINATION: at least four questions of different difficulty, two of which at least verting on the general part. The number of questions is related to the capacity of the student to correctly and exhaustively answer.
    The exam is failed if the student does not reach any of the outcomes described in the section “Obiettivi formativi” (educational aims). The SCORE is a grade expressed in thirtieth weighted on the preparation of the student related to the knowledge, understanding of the subject, skill of analysis and interpretation of the legal text, capacity to assimilate the competences required in a clear way, lineal and reasoned, with the following level:
    - Sufficient: grade from 18 to 21;
    - Decent: grade from 22 to 24;
    - Good: grade from 25 and 26;
    - Very good: grade from 27 to 29;
    - Excellent: grade from 30 to 30 cum laude.
    FOR THE ATTENDING STUDENTS: the professor considers, with a maximum threshold of the 30% of the final score, of the evaluations derived from the exercises carried out in class.
    FOR THE NON ATTENDING STUDENTS: the final grade is determined in accordance with the outcome of the oral examination and the indicators of the “Educational aims”.

    Other information

    Attending students (attendance equal to or higher than 70% of the lectures) will be informed of the exam program.
    Possible alternative readings or programs may be agreed between the students and the Professor on the basis of the individual interests and needs emerged during the lectures.
    Participation is not mandatory.
    WORKING STUDENTS INCLUDED IN AFFILIATED AND PARTNER PROJECTS: The lecturer schedules specific tutorial meetings for the working students, following a calendar agreed with the Partner Entities. The study program, to achieve the educational objectives, is equivalent to the attending students (see, the relevant textbooks) integrated by handouts and other materials provided by the teacher when the tutorial activities are concluded. The burden implied in these programs does not imply, in any case, a lower commitment than the students community at large.

    Course Syllabus

    The course deals with the following topics from a comparative perspective:
    I. Sharì‘a and the system of sources (usùl al-fiqh); Islam, the Community of believers (umma) and the ethical-religious fundamentals of law; the concept of shari‘a; fiqh and the classification of legal acts; the sources (usul al-fiqh): The Qur’an - Sunna – the Community’s consent (igma‘) – the analogical procedure (qiyas) – the custom (‘urf) – other subsidiary sources – legal practice and case-law (‘amal). Hermeneutical activity of the legal doctrine (igtihad and taqlid).
    II. The legal institutes (furû‘ al-fiqh) and the codification (qànùn) The ‘ibadat (namely the acts of worship and other rituals) and the mu‘amalat (negotia). The people – family law – rights in rem and possession – obligations and contracts – penal law – judge and the trial.
    III. Law, religion and politics under islàm; politics (siyasa) from the Caliphate to the Nation State; the codification and the new sources of law; Nizam and qanun: executive power and legislative power in Muslim countries; the three codification rule models: the ottoman rule model, the Maghreb rule model and the Egyptian rule model; interpretation and application of Muslim law in contemporary Muslim countries.
    IV. Current law and trends in Muslim countries: some cases; family law and the issue of women; religious freedom and freedom of worship; islàm and human rights; Islamic banking and finance; the constitutions of Muslim countries and the role of shari’a.
