Il corso intende:
1) Offrire allo studente un percorso introduttivo al diritto comparato, sia come scienza sia come metodo, con attenzione alla metodologia comparativa.
2) Fornire le basi per un’apertura critica verso la diversità e la complessità delle esperienze giuridiche nel contesto globale.
3) Consentire allo studente di introdursi nelle diverse aree del diritto e di affrontare lo studio dei diversi sistemi giuridici nel panorama giuridico mondiale.
DESCRITTORI dei risultati di apprendimento:
CONOSCENZA E CAPACITÀ DI COMPRENSIONE: conoscenza dei caratteri fondamentali dei principali sistemi giuridici, della loro evoluzione storica, dei concetti e dei termini peculiari; riconoscere la presenza in diversi contesti di diversi tipi di diritto e di comprendere le loro interazioni.
CONOSCENZA E CAPACITÀ DI COMPRENSIONE APPLICATE : consapevolezza della complessità dei fenomeni giuridici nel tempo e nello spazio; capacità di collocare il diritto italiano in un contesto più ampio, di essere attenti alle questioni metodologiche connesse alla conoscenza del diritto straniero e di operare in ambiti sempre più internazionalizzati.
AUTONOMIA DI GIUDIZIO: applicazione del metodo comparativo; capacità critica nel riuscire in modo autonomo ad identificare e spiegare somiglianze e differenze tra i sistemi giuridici considerati; possedere gli strumenti più idonei per passare da una comparazione di tipo descrittivo ad una comparazione di tipo valutativo, ovvero ad una comparazione critica.
ABILITÀ COMUNICATIVE: dimostrare di saper comunicare in modo chiaro e senza ambiguità le proprie conoscenze, di saper esporre le nozioni acquisite con coerenza argomentativa, rigore logico-sistematico e proprietà di linguaggio nonché di saper esprimere le proprie considerazioni e conclusioni.
CAPACITÀ DI APPRENDIMENTO: capacità di valutare l’accesso a momenti formativi successivi, sempre più specialistici, e autonomia nel reperire le fonti per un aggiornamento costante delle competenze.

Si consiglia di aver completato lo studio del diritto privato e del diritto pubblico.

Il corso è suddiviso in DUE MODULI che si svolgeranno entrambi nel corso di un semestre didattico. Le attività didattiche sono così organizzate:
- lezioni frontali (70% delle ore previste),
- esercitazioni (20%),
- seminari con docenti esterni (10%).
Come ausilio alle lezioni frontali possono essere utilizzati: slide, supporti informatici, audio e video.
Le esercitazioni in aula saranno curate dagli studenti, in forma individuale o di gruppo, e programmate con il docente con almeno una settimana di preavviso. Tali esercitazioni verteranno sull’analisi di casi o questioni pratiche, in forma scritta e orale, da presentare e discutere in aula. Al termine dell’esercitazione il docente esprime una valutazione di cui terrà conto anche in sede di verifica finale in misura non superiore al 30% della valutazione complessiva.
ATTIVTA’ DI TUTORATO E RECUPERO: Nel corso del semestre, su richiesta degli studenti, potranno essere organizzati incontri didattici per il tutorato o il recupero di argomenti trattati nel corso delle lezioni.

Ciascuno studente può OPTARE PER L’ESAME SCRITTO OVVERO L’ESAME ORALE prenotandosi ai corrispondenti appelli. In entrambi i casi vengono proposti quesiti attinenti a profili generali e specifici (vd. “Contenuti”).
PROVA SCRITTA: da quattro a sei domande a risposta aperta di diversa difficoltà, delle quali almeno due sulla parte generale, da completare in 2 ore. In caso di esito positivo, lo studente potrà comunque chiedere al docente un’integrazione orale della prova.
PROVA ORALE: minimo quattro domande di diversa difficoltà, delle quali almeno due sulla parte generale. Il numero delle domande dipende dalla capacità dello studente di rispondere in modo corretto ed esaustivo.
L’esame non sarà superato se lo studente non raggiunge nessuno dei risultati descritti al punto “Obiettivi formativi”.
Il PUNTEGGIO è un voto espresso in trentesimi ponderato sulla preparazione dello studente in base a conoscenza, comprensione della disciplina, capacità di analisi e di interpretazione dei dati giuridici, capacità di restituire le competenze acquisite in forma chiara, lineare e ragionata, di livello:
- sufficiente: voto tra 18 e 21;
- discreto: voto tra 22 e 24
- buono: voto tra 25 e 26
- molto buono: voto tra 27 e 29
- eccellente: voto tra 30 e 30 e lode
PER GLI STUDENTI FREQUENTANTI:
il docente tiene conto, in misura non superiore al 30% della valutazione complessiva, delle valutazioni espresse in riferimento alle esercitazioni svolte in aula.
PER GLI STUDENTI NON FREQUENTANTI il voto finale è determinato sulla base della corrispondenza tra esiti della prova scritta e/o orale e descrittori degli “Obiettivi formativi”.

La frequenza al corso non è obbligatoria.
Gli studenti sono considerati frequentanti con una presenza alle lezioni pari o superiore al 60%. Al fine di equilibrare il carico di studio e di lavoro tra studenti frequentanti e non frequentanti, il docente comunica ai frequentanti gli adattamenti del programma che possono essere presi in considerazione ai fini dello studio per la verifica finale. Tali adattamenti consistono nel dispensare da specifiche parti dei libri di testo su argomenti che sono approfonditamente svolti in aula o nella loro sostituzione con materiale di studio fornito dal docente. In ogni caso detti adattamenti sono proporzionali all’effettiva frequenza al corso.
Letture integrative possono essere concordate direttamente con il docente sulla base degli interessi e delle esigenze formative individuali.
STUDENTI LAVORATORI INSERITI NEI PROGETTI IN CONVENZIONE: Il docente organizza specifici incontri di tutorato per gli studenti lavoratori secondo un calendario concordato con gli Enti convenzionati. Il programma di studio, per il raggiungimento degli obiettivi formativi, è equivalente a quello degli studenti frequentanti (vd. Testi di riferimento) integrato da dispense e altri materiali forniti dal docente a conclusione dell’attività di tutorato. La consistenza di tali programmi non comporta, in ogni caso, un impegno di formazione inferiore a quello richiesto alla generalità degli studenti.

The course aims to:
1) Offer the student an introduction to comparative law, both as a science and as a method, focusing on comparative methodology.
2) Provide the basis for a critical awareness of the diversity and complexity of legal experiences in the global context.
3) Allow the student to enter the different areas of law and to study different legal systems in the global legal landscape.
DESCRIPTORS of learning outcomes:
KNOWLEDGE AND UNDERSTANDING: knowledge of the fundamental characteristics of the main legal systems, their historical evolution, their specific concepts and terms; to recognize different types of law in different contexts and to understand their interaction.
APPLIED KNOWLEDGE AND UNDERSTANDING ABILITY: awareness of the complexity of legal issues in time and space; ability to place Italian law in a broader context, to be conscious of methodological questions related to knowledge of foreign law and to operate in increasingly internationalized environments.
JUDGMENT SKILLS: application of the comparative method; critical capacity in being able independently to identify and explain similarities and differences between the legal systems considered; possess the most suitable tools to progress from a descriptive comparison to an evaluative or critical comparison.
COMMUNICATION SKILLS: ability to communicate knowledge clearly and unambiguously, to argue the concepts acquired consistently, logically and coherently as well as being able to express personal considerations and conclusions.
LEARNING SKILLS: ability to evaluate access to subsequent, increasingly specialized training programmes and independently find the sources to upgrade skills.

It is advisable to have completed the study of private law and public law.

The course is divided into TWO MODULES, both taught during the same semester. Educational activities are organized as follows:
- lectures (70% of the scheduled hours),
- exercises (20%),
- seminars with visiting lecturers (10%).
As an aid to lectures the following may be used: slides, computer media, audio and video.
Classroom exercises will be carried out by students, individually or in groups, and scheduled with the teacher at least one week in advance. Sessions focus on the analysis of cases or practical issues, in written and oral form, to be presented and discussed in the classroom. At the end of the session the teacher evaluates the students. This will also be taken into account in the final assessment, not exceeding 30% of the overall assessment.
TUTORIAL AND RECOVERY ACTIVITIES: During the semester, when personally required by the student(s), tutorial meetings could be scheduled for the recovery of topics dealt during the lectures.

Each student can OPT FOR THE WRITTEN EXAM OR THE ORAL EXAM by registering for the corresponding exam session. In both cases questions related to general and specialist course content are included (see Contents).
WRITTEN TEST: four to six open-ended questions of varying difficulty, of which at least two focusing on the general part, to be completed in 2 hours. In the event of a positive outcome, the student can still ask the teacher to integrate this result with an oral test.
ORAL TEST: minimum four questions of varying difficulty, of which at least two covering the general part. The number of questions depends on the student's ability to respond correctly and comprehensively.
The exam will not be passed if the student does not reach any of the results described in the Training objectives section.
The FINAL MARK is out of 30, based on the students knowledge, understanding of the discipline, ability to analyze and interpret legal information, ability to display the skills acquired in a clear, straightforward and reasoned manner:
- sufficient: between 18 and 21;
- fair: between 22 and 24
- good: between 25 and 26
- very good: between 27 and 29
- excellent: between 30 and 30 cum lode
FOR ATTENDING STUDENTS:
the teacher takes into account an evaluation of the exercises carried out in the classroom, not exceeding 30% of the overall evaluation
FOR NON-ATTENDING STUDENTS the final mark is determined on the basis of the correspondence between the results of the written and/or oral test and descriptors of the Training objectives.

Course attendance is not mandatory.
Attending students are expected to develop a course attendance rate of 60% or more in class. In order to balance the study/work load between attending and non-attending students, the lecturer will inform attending students any adaptation of the programme that may be taken into consideration for the purposes of their study for final assessment. Adaptations range from dispensing with specific parts of the textbooks on topics that are thoroughly covered in the classroom or replacing parts of the textbook with study material provided by the teacher. In any case, any adaptations are proportional to actual course attendance.
Additional readings may be agreed upon directly with the teacher based on individual interests and needs.
WORKING STUDENTS INCLUDED IN AFFILIATED AND PARTNER PROJECTS: The lecturer schedules specific tutorial meetings for the working students, following a calendar agreed with the Partner Entities. The study program, to achieve the educational objectives, is equivalent to the attending students (see, the relevant textbooks) integrated by handouts and other materials provided by the teacher when the tutorial activities are concluded. The burden implied in these programs does not imply, in any case, a lower commitment than the students community at large.
