    Contenuti

    Il corso mira a consolidare la conoscenza dello studente delle nozioni di diritto pubblico generale con specifico riferimento alla disciplina del turismo e alla normativa in materia turistica, partendo dal sistema delle fonti internazionali e interne e dal riparto delle competenze normative e amministrative in ambito italiano. Ulteriori livelli di approfondimento riguardano: l'organizzazione pubblica del turismo, le imprese turistiche, le strutture ricettive; le professioni turistiche; le tipologie speciali di turismo; l'uso turistico del demanio marittimo.

    Obiettivi formativi

    Conoscenza e capacità di comprensione.
    Lo studente dovrà dimostrare una conoscenza almeno sufficiente degli argomenti indicati nel programma, unita alla capacità di comprensione della disciplina, con riguardo tanto agli istituti analizzati quanto ai princípi e agli elementi di teoria generale che governano il vigente sistema del diritto del turismo. Dovrà, inoltre, offrire prova della sua abilità nell’elaborare idee autonome e originali, anche nella prospettiva della ricerca normativa, giurisprudenziale e bibliografica.

    Conoscenza e capacità di comprensione applicate.
    Lo studente dovrà dimostrare capacità di conoscere la materia tanto in relazione alla morfologia strutturale dei soggetti preposti alla tutela amministrativa dell’ambiente, quanto in termini di funzionamento delle procedure amministrative e di analisi dei relative provvedimenti.

    Autonomia di giudizio.
    Lo studente dovrà offrire prova della sua capacità nell’analisi e nell’interpretazione del sistema normativo che regge il diritto pubblico del turismo.

    Abilità comunicative.
    Lo studente dovrà dimostrare di saper comunicare in modo chiaro e senza ambiguità le proprie conoscenze, di saper esprimere le proprie considerazioni e conclusioni anche nell’àmbito del confronto in aula su testi normative o decisioni giurisprudenziali (working class) che verranno proposti. Lo studente deve dimostrare di saper esporre le nozioni acquisite con linearità di pensiero, rigore logico-sistematico e proprietà di linguaggio.

    Capacità di apprendere.
    Lo studente dovrà dimostrare di aver sviluppato capacità di comprendere principi e regole del diritto pubblico del turismo, anche nella prospettiva di uno studio della disciplina autonomo e consapevole, funzionale a un aggiornamento costante delle proprie competenze.

    Conoscenza del diritto pubblico italiano.

    Metodologie didattiche

    Lezioni frontali e interattive con il supporto di diapositive digitali esplicative degli argomenti trattati (36 ore).

    Metodi di valutazione

    La verifica dell’apprendimento matura attraverso una prova orale o scritta. La richiesta di prova scritta comporta specifica comunicazione al docente, via posta elettronica istituzionale, almeno 5 giorni prima dell’appello. La prova orale consiste in un colloquio articolato, la cui valutazione mira a verificare lo studente abbia acquisito conoscenza della disciplina, capacità di interpretazione dei dati normativi e giurisprudenziali, capacità di esporre in forma chiara e ragionata. La valutazione rispetta i seguenti criteri: • Mancato superamento dell’esame: preparazione insufficiente; • Da 18 a 21: preparazione sufficiente. • Da 22 a 24: preparazione pienamente sufficiente. • Da 25 a 26: preparazione buona. • Da 27 a 29: preparazione molto buona. • Da 30 a 30 e lode: preparazione eccellente. La prova di valutazione scritta degli studenti lavoratori, in forma di questionario, è articolata in due sezioni: la prima contempla quindici domande a risposta multipla, che traggono spunto dai quesiti sottoposti agli studenti attraverso i test di autovalutazione; la seconda prevede tre domande a risposta aperta, adeguate a saggiare l’effettiva comprensione degli snodi critici relativi agli elementi fondamentali del programma dell’insegnamento. Ai fini della valutazione finale, ciascuna sezione incide nella misura del 50%.

    Possono essere predisposti programmi alternativi e/o focalizzati su determinate esigenze formative, destinati agli studenti lavoratori che afferiscono ai percorsi loro dedicati nell’ambito delle attività didattiche del Dipartimento, anche in convenzione, nonché agli studenti iscritti nell’ambito del Protocollo PA 110 e lode sottoscritto dall’Ateneo.

    La frequenza del corso non è obbligatoria, ma è particolarmente consigliata.

    Durante il corso, saranno messi a disposizione dello studente, attraverso le piattaforme digitali di Ateneo, alcuni test di autovalutazione per evidenziare gli argomenti più importanti delle lezioni e per consentire allo studente di esercitarsi in vista degli esami di verifica dell’apprendimento.

    Le fonti internazionali e interne del diritto del turismo. Costituzione e riparto di competenze normative e amministrative in materia di turismo. L’organizzazione pubblica del turismo: governance nazionale e regionale; I sistemi turistici locali. Le imprese turistiche e le attività ricettive. La disciplina delle professioni turistiche. Le tipologie speciali di turismo (ecoturismo; agriturismo; turismo sociale; pescaturismo; turismo religioso; turismo sportivo). L’uso turistico del demanio marittimo: natura e disciplina del provvedimenti di concessione.

    The course aims to consolidate the student's knowledge of the notions of general public law with specific reference to the discipline of tourism and tourism legislation, starting from the system of international and internal sources and from the division of regulatory and administrative skills in the Italian context. Further levels of study concern: the public organization of tourism, tourism businesses, accommodation facilities; tourism professions; special types of tourism; the tourist use of the maritime domain.

    Course objectives

    Knowledge and understanding.
    The student must demonstrate at least sufficient knowledge of the topics indicated in the program, combined with the ability to understand the discipline, with regard to both the institutions analyzed and the principles and elements of general theory that govern the current system of tourism law. It will also have to offer proof of its ability to develop autonomous and original ideas, also from the perspective of normative, jurisprudential and bibliographic research.

    Applied knowledge and understanding.
    The student will have to demonstrate the ability to know the subject both in relation to the structural morphology of the subjects in charge of the administrative protection of the environment, as well as in terms of the functioning of administrative procedures and analysis of the related measures.

    Autonomy of judgment.
    The student must offer proof of his ability in the analysis and interpretation of the regulatory system that governs public tourism law.

    Communication skills.
    The student will have to demonstrate that they are able to communicate their knowledge clearly and unambiguously, that they are able to express their considerations and conclusions also in the context of the classroom debate on regulatory texts or jurisprudential decisions (working class) that will be proposed. The student must demonstrate to be able to expose the acquired notions with linearity of thought, logical-systematic rigor and properties of language.

    Ability to learn.
    The student will have to demonstrate that they have developed the ability to understand the principles and rules of public tourism law, also in the perspective of an autonomous and conscious study of the discipline, functional to a constant updating of their skills.

    Prerequisites

    Knowledge of Italian public law.

    Teaching methods

    Frontal and interactive lessons with the support of explanatory digital slides of the topics covered (36 hours).

    Evaluation methods

    Verification of learning matures through an oral or written test. The request for a written test involves specific communication to the teacher, via institutional e-mail, at least 5 days before the exam. The oral exam consists of an articulated interview, the evaluation of which aims to verify the student has acquired knowledge of the discipline, ability to interpret regulatory and jurisprudential data, ability to present in a clear and reasoned way. The assessment meets the following criteria: • Failure to pass the exam: insufficient preparation; • From 18 to 21: sufficient preparation. • From 22 to 24: fully sufficient preparation. • From 25 to 26: good preparation. • From 27 to 29: very good preparation. • From 30 to 30 cum laude: excellent preparation. The written assessment test of working students, in the form of a questionnaire, is divided into two sections: the first contemplates fifteen multiple choice questions, which are inspired by the questions submitted to students through the self-assessment tests; the second includes three open-ended questions, adequate to test the effective understanding of the critical issues relating to the fundamental elements of the teaching program. For the purposes of the final evaluation, each section has an impact of 50%.

    Other information

    Alternative programs can be prepared and / or focused on specific training needs, intended for student workers who belong to the courses dedicated to them within the didactic activities of the Department, also in agreement, as well as for students enrolled under the PA 110 e lode Protocol. signed by the University.

    Attendance of the course is not compulsory, but it is particularly recommended.

    To take the exam, the study plan does not provide for prerequisites.

    During the course, some self-assessment tests will be made available to the student, through the University's digital platforms, to highlight the most important topics of the lectures and to allow the student to practice in view of the learning assessment exams.

    International and internal sources of tourism law. Establishment and distribution of regulatory and administrative competences in the field of tourism. The public organization of tourism: national and regional governance; Local tourism systems. Tourism businesses and hospitality businesses. The discipline of tourism professions. The special types of tourism (ecotourism; agritourism; social tourism; fishing tourism; religious tourism; sports tourism). Tourist use of the maritime domain: nature and discipline of the concession measures.
